What’s the Law?

State laws in Colorado declare—with some exemption—that all publically- and privately-owned companies that have one or more part-time or full-time employees provide workers’ compensation coverage for their employees. This coverage must be completely funded by the employer, not the employee.

According to the Colorado Department of Labor and Employment, exemptions for the law can include:

  • Casual repair work for a business earning less than $2,000 in a year for that work
  • Commissioned real estate agents and brokers with a license
  • Drivers under a lease agreement with a contract carrier
  • Federal employees
  • Independent contractors working for-hire transportation jobs
  • Part-time domestic or repair work for a homeowner
  • Persons providing host home services as a part of residential service and support
  • Railroad employees
  • Some independent contractors
  • Volunteers for a ski-area operator

By law, employers must also provide employees with a “Notice to Employees” that explains proper notification procedures and deadlines for reporting an accident in the workplace.
