Workers' Comp: Civil Lawsuits & Suing An Employer

In Colorado, barring some exceptions, companies that employ one or more full-time or part-time employee are required to carry workers’ compensation insurance from an authorized insurance company. Companies that refuse to provide workers’ compensation could face penalties and/or fines and be subject to a civil lawsuit should an employee be injured on the job.

Can Injured Employees Sue Their Employers?

Each state has its own workers’ compensation laws to protect both employees and employers. Workers’ compensation is designed to make sure employees get the benefits they need to recover after on-the-job injuries and illnesses, while it is also designed to protect employers from facing civil lawsuits.

Through workers’ compensation, injured employees receive their benefits from their employers’ insurance companies; if an employer is exempt from providing workers’ compensation or the employer refused to carry workers’ compensation insurance, the company could face lawsuits for damages incurred by injured workers.

If a lawsuit is filed against an employer that doesn’t provide workers’ compensation insurance, a judge will decide if the employer owes the employee compensation for the injury or illness suffered.

Third-Party Lawsuits

In addition to receiving workers’ compensation, an employee may file a lawsuit if a third party caused the on-the-job injury or illness. The employer may also file a suit against the third party, asking for compensation for the benefits the employer’s insurance company had to pay the injured employee.
