admin October 16th, 2007

October 16, 2007

Following a fatal auto accident last March, parents of three teens have filed a Colorado wrongful death lawsuit against the driver of a truck whose vehicle struck the SUV carrying the teens. According to the Durango Herald, Eugene Chavez was driving a commercial vehicle for TRC Companies when he veered off Colorado Highway 140, striking the SUV, which was parked in a private driveway. According to officials, Chavez was traveling about 55 to 65 mph when he struck the parked SUV.

Chavez said that he was trying to avoid a Colorado state trooper that was parked on the wrong side of the highway, facing the wrong direction when he veered off the highway. The lawsuit filed against him alleges he exceeded the legal amount of hours allotted for commercial drivers as well as negligent driving.

Also named in the Colorado wrongful death lawsuit are La Plata County, the sheriff’s deputy who had stopped his car on the highway, and TRC Companies, Inc./Cubix Corporations.
